Scope of Work The City of Cupertino invites Statement of Qualifications (SOQ) submittals from qualified professionals (Consultants) to provide Solid Waste Consulting services. The City of Cupertino (City) seeks to secure high quality firms to be pre-qualified to perform Solid Waste Consulting services to meet industry standards, ensure compliance with state laws, assist in rate studies, and provide agreement compliance evaluations and auditing. Proposers shall indicate in their submission which scope of work topic areas are supported in their proposals. The Solid Waste Consulting scope of services includes, but is not limited to, furnishing all materials, equipment, labor, and services associated with tasks in these five topic areas: I. Hauler and Facility Agreement Support: • Rate adjustment reviews o Regularly scheduled rate adjustment review (typically annually) of documentation provided by the hauler Recology as required by the franchise agreement. o Regularly scheduled rate adjustment review of documentation provided by other service providers (e.g. a facility). • Cost-based adjustment reviews o Regularly scheduled cost-based rate adjustment review (typically every four years or more often as established by City) of documentation provided by the hauler as required by the franchise agreement. o Other cost-based adjustment reviews that may be needed to assess documentation provided by other service providers (e.g. Sunnyvale Materials Recovery and Transfer Station [SMaRT Station®] or GreenWaste Zanker). • Cost of services reviews and analyses as may be needed for hauling, processing, or landfilling services (e.g. sector analysis between categories of generators). • Support for management of current agreements. • Billing audit and performance reviews of the hauler. • Billing audit and performance reviews of facilities (e.g. materials recovery facility [SMaRT Station®], organics processing facilities, recycling facilities [GreenWaste Zanker]). • Support negotiating contract extensions with the hauler or other service providers. • Solicitation development, review, negotiation, and support as may be needed for new agreements. • Review and analyze disposal records available to the City from the hauler, County, and State. Provide guidance on conducting accuracy assessments between the sources of data, including establishing a set of data best management practices. Provide guidance on actions to research and resolve anomalous findings. • Other undefined tasks related to the support activities listed above. Page 2 City of Cupertino RFQ Solid Waste Consulting Services II. Regulatory Compliance Support: • Support for ensuring City compliance with state laws relating to waste management. The State of California has multiple laws that solid waste generators and jurisdictions are required to comply with and report on (e.g. SB 54, SB 1383). o Assist with strategic planning to respond to existing and new regulations or requirements. o Provide monitoring and evaluation of hauler compliance with SB 1383 or other state law requirements on behalf of the City. o Assess the City’s existing programs for gaps in compliance. o Support staff in case of CalRecycle in-person SB 1383 compliance audit. o Other undefined tasks related to the support activities listed above. III. Strategic Planning Support: • Support for responding to legal challenges. o There is a shifting landscape of legal activity related to aspects of franchise agreements that may need to be evaluated, responded to, or planned for, including nexus studies of activities that support collection services. • Support for budget planning relating to waste management activities, including strategic use of dedicated funds to mitigate rate increases. • Other undefined tasks related to the support activities listed above. IV. Policy Support: • Analysis and support for consideration of updated construction and demolition debris diversion requirements or ordinances. (e.g. requiring deposits refundable upon meeting diversion requirements, issuing financial penalties for failing to meet diversion requirements, or contemplating other types of incentives to achieve required diversion). • Drafting or reviewing ordinances or policies related to solid waste, recycling, and composting (e.g. updating trash enclosure or trash management guidance documents). • Assess City municipal code for potential gaps related to compliance with regulations. • Other undefined tasks related to the support activities listed above. V. Outreach and Diversion Programmatic Planning and Implementation Support: • The City has outreach and diversion programs in place but may need assistance evaluating their effectiveness and reviewing and updating practices. • Staff may require assistance to develop and implement such outreach activities. • Other undefined tasks related to the support activities listed above.
